Rash driver gets 2 years in jail for injuring three | Ahmedabad News

Ahmedabad: A local court sentenced a man to two years’ imprisonment in a road accident case in which his car hit a bench, injuring three persons.
According to the case details, the accused, Nilav Mehta, was driving his car rashly and hit a bench near a commercial complex in Thaltej on the evening of Feb 15, 2012. Three youths — Mehul Chauhan and his cousins Sulabh and Mayur — sitting on the bench sustained injuries. Later, Mayur’s left leg had to be amputated.
Following investigation, Mehta, who had fled the spot, was charged with rash driving and causing grievous hurt.
After the trial, additional chief judicial magistrate first class at Ahmedabad rural court, K N Nimavat, found him guilty. Mehta pleaded for leniency and urged for the benefit of probation under the Probation of Offenders Act.
The court rejected the request, stating, “Frequency of accidents has increased nowadays, and they take a toll on innocent people. Therefore, it is not proper to grant the benefit of probation.”
While the court punished Mehta with a three-month jail term for rash driving and for violation of the provisions of the Motor Vehicles Act, it awarded him a two-year jail term under Section 338 of IPC for causing grievous hurt by an act endangering life or personal safety of others.
