Ahmedabad: A commercial court in Ahmedabad temporarily restrained a cafe owner, Jayesh Patel, from using the name ‘Don Ka Adda’ for his newly opened outlet on SG Highway. The court passed the order after another cafe owner, Nimesh Khakhariya, filed a suit alleging trademark infringement.In his suit before the commercial court, filed through advocate Zahid Shaikh, Khakhariya stated that he was running a cafe under the same name since 2019 and that the trademark was registered in the name of Amit Khakhariya, who issued a no-objection certificate for the transfer of rights. The suit stated that Patel approached him in May seeking franchise rights, but no agreement was reached.Later, Khakhariya learned Patel opened a cafe under the name ‘#I love Don Ka Adda’ and promoted it on Instagram. He also learned that Patel applied for a similar trademark. He claimed that using the mark for the eatery, for which he got a registration, was an infringement on his trademark rights according to the law. He filed another application seeking an interim injunction for a temporary stay until the pendency of the suit.After the preliminary hearing on the demand to stay Patel from using the mark, commercial court judge K S Trivedi passed an ex-parte order, stating, “Looking to the facts of the present case, there appears prima facie case, the balance of convenience is in favour of the plaintiff and irreparable loss is likely to be caused to the plaintiff if ad-interim injunction is not granted.”
